Does Jose Baez Know How He Will Utilize His Experts?

On Monday, November 29, 2010, defense attorney Jose Baez was ordered to submit a written list of his expert witnesses and the subject matter to which they would testify.

Mr. Baez first submitted a list of names with no indication of subject matter.  After a request for more detail in compliance with the original court order, Mr. Baez again submitted a list of names with no subject matter, although he did add the general scientific area in which the expert is an expert.  However, their area of scientific expertise does not identify the specific subject matter in this case to which they will testify.

After yet another request to comply with the court’s original order, Mr. Baez sent an insulting e-mail to the state prosecutor which attempted to belittle the prosecutor for requesting Mr. Baez comply with the court’s order.

The reaction of Mr. Baez to the third request is a defensive reaction.  Mr. Baez does not wish to reveal the subject matter to which his experts will testify.  Mr. Baez is afraid to reveal this information, leading him to insult the prosecutor in an attempt to forestall further requests.

“DR. HENRY LEE (Criminalist: He inspected the car and was at the evidence inspection and inspected the scene  ALL OF WHICH YOU ALREADY KNEW)”

The question the court asked Mr. Baez is what subject matter will the expert address.  Mr. Baez avoids answering.  Although Mr. Ashton may know the specific pieces of evidence inspected by Dr. Lee, he did not know if Dr. Lee will testify to these pieces and still does not based upon Mr. Baez’s response.

“ALL OF WHICH YOU ALREADY KNEW” – All capital letters indicate this response is extremely emotional for Mr. Baez as he is performing the written equivalent of screaming at Mr. Ashton.  Mr. Baez screams to scare Mr. Ashton away from again requesting Mr. Baez to comply with the order.  Mr. Baez is emotional because he fears complying with the court’s order.  The statement is factual, Mr. Ashton did know these things, but he still does not know the answer to the court’s query.

“DR. WERNER SPITZ (forensic pathology: Performed the second autopsy on Caylee, YOU ALREADY KNOW THIS (SPOKEN IN OPEN COURT)”

But what subject matter will Dr. Spitz testify about?  We do not know.  Mr. Baez would like us to assume the second autopsy of Caylee Anthony, but he did not state this specifically.  We now know the reason Judge Perry required Mr. Baez to submit a written response.  Judge Perry knew Mr. Baez could not be trusted to verbally comply with the order as this response demonstrates.

“DR. KATHY REICHS (anthropology: Conducted the anthropological exam on Caylee and will testify on these topics, THIS YOU KNOW)”

“these topics” – The topics are close to Mr. Baez.  He is happy with this expert and their testimony.  But what are the “topics”?  Mr. Baez only address anthropology, but “topics” is plural.

“DR. JANE H. BOCK (Botany: Reviewed Hall’s report and inspected the scene and will testify about BOTANY, PLEASE TELL ME YOU KNEW THIS)”

“PLEASE TELL ME YOU KNEW THIS” – How would Mr. Ashton know “this” prior to Mr. Baez’s disclosure as ordered by the court?  Why is Mr. Baez angry Mr. Ashton wishes to clarify?  Anger is an outgrowth of fear.

“DR. TIM HUNTINGTON (Entomology will testify about Entomology, you have been involved in every area that he has inspected)”

“every area that he has inspected” – Mr. Baez shows sensitivity to areas with bugs as seen by his use of the extra word “every” and by distancing himself with “that”.

“DR. SCOTT FAIRGRIEVE (K-9 issue, as mentioned he will testify at that hearing if we have one)”

Mr. Baez is not happy about “that hearing” which he distances himself from with “that”.  Mr. Baez is concerned about the findings of the cadaver dogs.  “If we have one” indicates Mr. Baez may not fight the inclusion of the cadaver dog reactions during their investigation.  Or he may be indicating he believes the trial process may be terminated prior to the need for a hearing.

“DR. KENNETH FURTON (Forensic Chemist will testify in all areas concerning Forensic Chemistry)”.

Mr. Baez again avoids naming the exact subject matter the expert will testify about.  Yes, the general area is Forensic Chemistry, but what specific evidence?

“DR. BARRY LOGAN (Forensic Chemist will testify in all areas of forensic Chemistry)”

Why does the defense require two forensic chemists and will they both testify about all areas of forensic chemistry in this case?  If so, why?

“DR. JOHN LEESON (Digital Forensics: As I am sure you know this has to do with the Computer)”

Which “Computer”, Mr. Baez?  There are at least two in this case, the notebook and the Anthony home computer.  However, phones also play a large part, specifically cell phones which are tiny computers.  Will the expert testify to the cell phones and text messaging?  Will the expert testify to the convoluted SIM card story told by Ms. Anthony?

“As I am sure you know” – Mr. Baez blames Mr. Ashton for his anger and fear in being forced to provide this information.  If Mr. Ashton knew, he would not have needed to request clarification with which the court agreed.

“DR. WILLIAM RODRIGUEZ (Anthropologist/Taphonomy: You know what he will testify to as you objected to it at the hearing and have read my motion)”

“You know what he will testify to as you objected to it at the hearing and have read my motion” – Mr. Baez is bitter towards Mr. Ashton.  Known or unknown, the court ordered Mr. Baez to submit a list detailing the subject matter to which the experts will testify.  If Mr. Baez wrote an entire motion about this expert, he should have no problem in listing a summary on this page without resorting to insults aimed at Mr. Ashton.  Yet, Mr. Baez takes the time to let Mr. Ashton know he is bitter about the order.  Again, Mr. Baez dodged answering exactly what the subject matter of testimony will be.

“RICHARD EIKELENBOOM (DNA expert, may testify about DNA)”

Notice this expert does not have a title.  Why?  Did Mr. Baez forget?  Or is this expert not so much of an expert?

“may testify” – Mr. Baez hints there may be no defense testimony about DNA, meaning the defense will not challenge the DNA findings of the state.

“Dr. Michael Freeman forensic Epidemiologist. (Will testify about Epidemiology if an issue arises, I would advise taking his depo last as he has not completed his work)”

“if an issue arises” – If there is not an issue now, what would cause one to arise?  Will the forensic findings change between now and the beginning of the trial?  Is Mr. Baez still waiting on discovery information?  What work is this expert doing which is not completed?

“MICHAEL O’KELLY (Cell Towers, He may testify about Cell Towers and Cell phones)”

“He may testify” – Mr. Baez is not sure how the prosecution will use Cell Towers and Cell Phones in court.

We have learned Mr. Baez fears revealing what his experts will testify about.  Mr. Baez may not be sure how he will utilize his experts even though the trial is less than six months away.

We have learned Mr. Baez holds an unprofessional personal grudge against Mr. Ashton, much like the one he harbors against Kathi Belich.

We have learned this case has affected Mr. Baez emotionally.  He is no longer able to carry out his duties in a professional manner.  He is no longer able to follow the guidelines of common courtesy.  Mr. Baez has lost control of his emotions and is spewing them forth in written form within the documentation of the case.

    Baez is the poster boy of bottom feeding lawyers. It’s incomprehensible that the Florida Bar allows his crap to continue!

    Bull,
    Baez has no clue as to how he’s going to utilize them. It will be a ditch effort at the last minute incorporated into his little colorful chart. I like watching Baez swing back and forth in his play-and-swivel chair! Now…that’s priceless!!

    You know, I don’t think Baez has ever behaved professionally. He’s an emotional adolescent, much like his client, her family, and his pardner Foghorn Leghorn. In my view, everything about lil Jose, including his emails, is evidence of his arrogance and arrested development. You could be right, though, that he’s slipping even further into the abyss. He did seem more agitated than usual at the hearing earlier this week.

      You got me here. He has always been unprofessional, but in a very Eddie Haskell kind of way. He acts good in front of the judge, but bad for the press where he accuses the state of conspiracy. Now we know he drops to an even lower level in his business communications.

        See, I don’t think he behaves like a good little sleazeball in front of the judge, either. He may start out like Eddie, but the act falls away quickly. It’s true he hasn’t yet gone snarky on the judge like he does routinely with Ashton, Burdick, LE, the OC jail, the media, and basically anyone who isn’t Jose Baez or Casey Anthony. But the way I see it, if Judge Perry doesn’t rein this horse’s ass in soon, little Jose will become just as overtly disrespectful to the judge as he is to everyone else. It’s a matter of time.

        I cannot wait until he shows JP some disrespect because I think it will be like sticking his hand in a hornet’s nest. Until then, Jose’s inability to control his emotions will work against the defense as the jury will not be inclined to like him.

    IMO Mason is the puppet master here. His hatred for the JAC has become paramount, now his aim is to cause the State as much money and inconvience as he can. Needless to say Baez is delighted with this approach as it fits his sleazy tactics to a tee.

    The words “professional” and “Baez” should not be used in the same sentence :mrgreen:

      Did you crack up like I did when Mason mumbled his $1 per page troubles to Judge Perry? I thought I would roll off my chair laughing when the Judge advised the 30 years of experience defense superstar about obtaining a contract when outsourcing business. I don’t guess an attorney runs into contracts much in the law game…

      What about in the phrase “Professional-strength Baez Repellent”? Comes in aerosol and environmentally-friendly squeeze spray.

      I, too, am wondering about a last minute submittal to the court.

      I believe sending it to Ashton only doesn’t comply with the order.

      However, Jose publicly stated he complied with the order and told Ashton the state didn’t need to file a motion because Ashton could call Jose anytime.

      This is very reminiscent of the Brad resignation when Jose took to the airwaves to proclaim Brad was a baby about the whole Jose lying about him thing and he could have just called instead of resigning.

      The new attorney Ann Finnell has behaved professionally. She has repeatedly announced that she is only working on the death penalty phase stuff, which may show some sensitivity towards not wanting to get dragged into Baez and Mason’s guilt phase nonsense. This is just the pretrial show. Imagine what the actual trial will bring!

        She is very professional. But she does seem to be moving a bit slowly. I think she has been stunned in court by the lack of preparation by the rest of the team.

        I hope they don’t stage whisper to each other through the whole trial like they have in the hearings.

        agree that she is mostly professional. except for her one time in court when she just really seemed to want to get her point acrosses to the judge and he did stop her on several occasions.but she is no boso. doesnt really fit his narcissistic ways.look the word(which may be spelled wrong)up in the dictionary and his fase will be there.

    I hope Mason is made to pay the extra $1…he, like Baez deserves a public tongue lashing by Judge Perry. I totally understand Jeff Ashton’s frustrations but wonder if he “jumped the gun” by raising them at Monday’s hearing?

      I hope Mason has to pay the entire bill. Because the dollar amount is above the JAC limit, I don’t believe they will pay anything.

    The defense vs. the prosecution is a pathetic mismatch of intelligence and professionalism.

    J.Perry and Ashton are just doling out rope as needed to Baez.

      I am wondering how Judge P sees the e-mails. He seems to be a stickler for social graces so I believe Jose’s obnoxious attitude will affect Judge P very negatively.

        agree to a point but i was a tad bit dissappointed in my favorite judge at the last hearing. felt he caved in to boso just a bit which may explain his hostile e-mails to ashton. with boso’s personality,the judge seemed to give him the amo to treat mr.ashton this way. he will juts plea, oh judge i didnt know or you didnt make it clear to me that you wanted/expected me to give more info. same with when he wanted more money,seamed he was able to snowball the judge by stateing well thats not what you said it was for and once again the judge caved and gave more money.boso REALLY NEEDS to be CALLED OUT on the money issues. SHOW PROFF! this is tax payeer money. they need to see the truth!

    Baez is in so over his head with this case. He’s got to be on a major ego trip with Casey Anthony. Any ethical attorney would have told her early on that he/she wasn’t qualified to handle her case and recommend her to someone competent. He should stick to chasing ambulances. I have a feeling he’s going to make a total fool of himself at the trial.

        great article. but we all know HE doesnt think he has done anything wrong. quite the contrair,nor does his clinent. and with his dram team they think she’s going to be found NOT GUILTY! they will be surprized as she will if any different

    I am not a lawyer nor do I pretend to be like Mr. Dim Light Baez. I have watched Law and Order for years and understand how the profession should behave and to do their job according to the rules of law. Mr. Baez’s problem is he is not passionate about the law. Never will be. He will always be mediocre. You are right about the Eddie Haskell resemblance. Funny.

    Hi Bull,

    Just curious, have you ever analyzed any of Judge Perry’s comments or statements? Or, has he said enough that you could do a statement analysis? Seems it would sure be interesting. I have him pegged as a teddy bear, all bark and no bite. And, Mason knows it. Hence, the team’s arrogance and disrespect for rules.

      There’s plenty of JP, but very little in written form because most of the written stuff is depos and interviews, either police or media. Which means to get some decent quotes, you have to transcribe them from video, very time consuming.

      I have never done so because I am focused on liars and JP does not lie.

      I think we will see the bite come January. I have been happy with most of his rulings. At this point, he is still training Baez and Mason. He is patient and explains, but each hearing he becomes less the teacher and more the disciplinarian. Once January hits and he takes over the scheduling, the training wheels will be off. If they fall down and scrape their knees, he might remind them to visit the nurse after court is dismissed, but I doubt it. He will keep this trial on schedule.

        hope your right. already said, i was a little disappointed in the last hearing with his desisions. hope by then, or maybe even before then,he GETS it with boso,and stands his grounds more. boso will push the buttons as far as this judge will let him. he has already proven this at least to me,if not anyone else.     This is the best site concerning the Casey Anthony case.

    Great insight into January, and about Judge Perry “training” the defense. One would think that Mason should already be up to speed even though he acts like this is his first experience working inside JPerry’s courtroom.

    Glad to know that I am not the only one to think that the Defense Team (a very loose translation) gets a little more stupid in thought and deed as the trial gets closer.

    Kathy-nice take on Baez not being passionate about the law. It is the ultimate mis-match, as he is up against Judge Perry, Ashton, and Burdick, a trio of icons who are both superior in mission and knowledge of the law. Perhaps he is not fully aware of why he will fall short for his client, and in his professional standing.

    His intellect does not rise much above the fifth grade level it seems, making him perfectly suited for television. So at least he has something to fall back on.

      nice comment kmom, they both know exactly what they are doing. trying to act stupid so they can set her up for a mistrial,or ineffective councel,or try to push the blame on judge perry. we all know this trial is all about who is to blame other than casey. there is no evidence casey did this,according to spindy(who creamated the bones) caylee is still alive. if on the jury you can pick,jessie,roy kronk,anyone of casey’s friends and lets not forget thee only one she swears under oath and would not change her story about NANNY THE ZANNY! be the jury here. who did it (EXCEPT) nothings been done cause zanny still has her and she is sill live(PER SPINDY) yea spindy will make your head spin. IF you arent as smart as a fith grader!

      I think they get a little more stupid in thought and deed as time goes on because they’re becoming more desperate as the time for the trail draws near.
