Will Coherency Be an Obstacle for Cheney Mason During Trial?

5 Feb

On November 17, 2010, defense attorney Cheney Mason participated in the deposition of Laura Buchanan.  The transcript of the deposition may be found at the following links.

http://www.docstoc.com/docs/70798777/20101117-Laura-Buchanan-Deposition-Pt1

http://www.docstoc.com/docs/70800957/20101117-Laura-Buchanan-Deposition-Pt2

Cheney Mason: “Do you remember telling us that the area that you searched from the road you went back and when they pointed out where the body was found?”

Laura Buchanan: “Can you ask me that again?”

Exactly.  Can he ask that again?

This question is so poorly worded even Mr. Mason himself is unable to rephrase it in a coherent fashion.

We have learned Mr. Mason may encounter trouble during trial presenting his queries in an understandable format for the witnesses.

    LOL

I haven’t read yet but the article made laugh right out loud!!

    Thanks Bull!

    now to read …

I’m not sure, but the judge may approve funds to hire a low-cost interpreter…One who translates mumbling… re-words questions asked…fixes all grammatical errors…and one who explains back to Mason and Baez what the judge requires.

A beautiful, innocent baby was murdered yet this case has become a joke. I never comment but do want you to know that I enjoy your posts very much.

Hi Bullstopper! I’ve just recently found your website and have been reading and lurking. I don’t comment because usually what I want to say someone else already has. But your article this morning hit home. Yesterday during the hearing Mason sat there as if he was in la la land and I think it is because he just can’t hear what he needs to be hearing or he just doesn’t care enough. If he was my attorney, I would give him a choice of three things. Either get ear equipment that works for his type of work, invest in an interpreter to set next to him and keep him fully informed of what’s going on or he is off my case. I love reading your articles and the comments. I hope this sweet little girl gets justice soon.

Oh my please tell me he isn’t going to be like this at trial?! I can’t believe how the media and some “experts” rated this man as a very good high profile death qualified attorney. Please tell me it isn’t so.. Still lmao!

hello to ya all yes l aggree nason does not seem interested in this case at all.if you look at him at the hearing on friday he is out of the picture for sure.maybe he dont care because of what bozo is doing did you all think of that?look he is under investigation plus all the lying he is doing and continues.l dont blame mason to look like that eitheir.he was a good attorney maybe at his younger age now because of all that is going down he is ashamed to be in the same room as bozo the clown which l dont blame him one bit.l think if he would tell the judge what ever he is feeling and he wants to go the next step would be pd would have to take over which puts the trial way back until the end of this year if it gets there.why is bozo lead attorney l dont know but he is not allowed to take a murder trial and he has so talk about going to do things his way and again someone should step in to ask why mason is not even paying attention.is it possible that if he steps away from this trial he wont get paid by bozo?where is he getting the money??mason cant even sue him later because in open court he said he was doing this pro bono but it looks like he is not interested in this case which l dont blame him but what will happen?bozo tells the judge yesterday that this case is a unqiue case what ever that means for the bird head.he also wanted to be told who the jury is coming from because he wants a fair trial for his girl period.if its true and mason does not seem interested in this case you can rest assure he will be the way he was on friday hearing which l dont blame him.with bozo lying and cheating the courts l would be like mason also.not too happy because of all these things happening to the clown and everyone knows that mason has joined that team not looking good for mason being in a trial that he dont want part of just imagine.

    • sandra February 26, 2011 at 4:03 am #

if he doesnt want to be there and he isnt being paid then he can leave just like all thee other pro bono attorneys. no chains holing him there.

Annie, I have to wonder at Mason’s motives for taking this case on. In the very beginning when he first jumped on this train wreck from hell, if I’m not mistaken, he stated to the court that it was going to be fun. I wonder if he is having fun now? Yesterday in court he rolled his eyes and almost acted like he was in pain while Baez was making his points? It was painful to listen and watch Baez. Secretly, I was laughing at my computer! I almost want to jump in my computer and do a happy dance in court because he’s foobar-ed this case so badly. Just my opinion. CA deserves her day in court. Caylee deserves justice! And if LB and JA keep pecking away at this case…they will lay it out perfectly and a guilty verdict will come down. Baez will never give over first chair and Mason can’t make him. But if he’s going to be part of this defense, he needs to come to attention and start taking part. And first things first….it starts with the hearing aid issue.

I loved this video. My thoughts are..maybe he better push his self away from the food table, pack a balogna sandwich and get on the phone, like HJP advises. He did alot of damage yesterday in court. Those experts that he’s talking’bout, not gonna be very happy to know that they are being made to look like clowns on National t.v and even thier twitters are on the record now. I think they are avoiding him like the plague and don’t want nothin to do with him and his “cause”. They have already gave him their opinions and Baez don’t like it. He wants to see them in person to ask if they could spin it for him. LOL! (Does that mean Lots of Luck? or Laugh out Loud?)

    • kas February 5, 2011 at 5:56 pm #

I think he is having big troubles with the Hearing Aid too. Even the best of Hearing Aids are tricky and Microphones mess with them big time. Toss in the echo effect a huge Courtroom has and I’ll bet he’s having a multitude of problems.

I don’t think Mason is above using them as an excuse, in fact I think he’s mentioned them to JP before, but he’s way too prideful to admit that he is having consistent trouble that he’s not sure how to remedy.

  8. shyloh February 5, 2011 at 4:50 pm #

Wow put a bar complaint out there and everyone shuts up. That was funny!

  9. damagdpets February 5, 2011 at 4:59 pm #

Mason is far from the Jerry Spence he thinks he is. On his best day I don’t think he can be as colorful…..

  10. Diana February 5, 2011 at 6:02 pm #

Cheney Mason should have gone into retirement and stayed. I think he is way past his experation date in the courtroom, and will be remembered as the goof who said he will walk out of court with Casey on his arm when the trial is over. The same guy who professed her guilt before joining in her defense!

    Hey Kat,

Took a drive north up to S.F. You can see San Quentin from your living room window?? You are so lucky to be living by the Bay. I love S.F.! The Wharf there is like no other!!

LOL @ Mason! All those microphones shoved in their faces suddenly don’t seem so important anymore 🙂

    • C~A February 6, 2011 at 9:35 pm #

Cecelia – a lot of unanswered questions and good ones at that. Are these all personal questions? We have not heard one word from Mallory. Do you know the deadline for all discovery? I suspect the ink in the diary will be not of 2003 and what do you know about an eyelash in a napkin? That I must say I have never heard of but am very interested! TKS

    • Katprint February 6, 2011 at 9:41 pm #

Well, let’s be fair. It’s not really the defense attorneys’ fault that the prosecution has very bad facts/evidence against their client. Casey’s poor planning (or non-planning) of Casey’s own life as well as her poor planning of Caylee’s murder are the fault of nobody else but Casey.

What IS the attorneys’ fault is failing to properly handle the case – including negotiating a plea agreement if appropriate, refraining from unnecessary and unproductive insults to provoke the police/DAs, using limited resources wisely, etc. – once it reached them. It boggles my mind that for several months after Caylee’s remains had been discovered, they could still have gone down to the courthouse and entered a guilty plea without the death penalty being on the table, but they let that opportunity pass by! And now it seems like Casey merely getting life imprisonment instead of the death penalty would be some sort of “win” instead of the worst case scenario. Talk about snatching defeat from the jaws of victory!

  13. kmom February 5, 2011 at 11:20 pm #

Mason’s diction is spot on when telling off the media however.

  14. Zoe February 5, 2011 at 11:43 pm #

Kmom–I totally agree with your thoughts re: Mason’s “selective hearing”. It appears that when he wants to hear and respond to someone (somewhat coherently), he passes muster. When he needs an “out” from a sensitive topic or is genuinely (?) confuzzled, he USES the “I can’t hear and I speak like a stroke-victim” excuse. Interesting, indeed! I used to think he had a wad of tobacco in his cheeks when he spoke, but then he never “spit” (gross), so what else is in there??? Marbles, Gobstoppers, cotton balls, poorly fitted dentures??? Who knows….but his inability to speak clearly and enunciate could make for the world’s longest trial! I hope this is not going to be the case!

I came across this silly “PR piece” from Jose that I just HAD to share. It’s hilarious…given Jose’s performance as Casey’s lawyer these past few years!

What about the card or alternate ID that was taken from the bag that Lee brought home from Tony’s apt.? Lee claimed an officer took it but I have not heard of it being in evidence…..I also wondered if Lee could have possibly replaced the hard drive in the laptop…it does not take long to do….

Two more observations from the peanut gallery here:
    1. Is that a TELEPHONE I see being utilized there??!?

  18. Anonymous February 6, 2011 at 10:55 am #

Cecelia-They do not believe that Casey is a liar yet Casey Anthony openly admitted to LE that she lied throughout her interrogation. Friends, family and classmates have chronicaled her lying beginning in 2002. Many described her as a pathological liar by 2008.

They believe that Tony L was somehow involved yet he had only seen the child three times and NEVER after June 2, 2008.

Jesse met Tony in May and only spoke to Casey on the phone AFTER June 16, 2008.

Amy H.was nowhere need Hopespring Drive on July 16, 2008.

Ricardo M. never saw Casey after June 9 but somehow where he was on June 16, 2008 doesn’t factor into their thinking when implicating poi-not to be confused with efforts to establish reasonable doubt.

Anyone who walks and talks and is within 100 yards of Suburban Drive after June 16, 2008 and before Dec 11, 2008 who was searching for the child or who actually found the child makes the cut for either a poi or a witness for the defense. They can be described as pedophiles, wife beaters and sexual deviants, and never recognized for what they actually did.

    The media whores? Beatify them.

Well I slogged through the entire Buchannon depo- what incredible patience and fortitude to stay on track by Linda Drane-Burdick. I wanted to scream just reading all the evasive answers by LB. Then to have Mason constantly not hearing or understanding, and then muddle up the waters with his ‘almost questions’ and Baez acting like a child, well I would have been needing a pitcher of martinis if I were Ms. Burdick.

    **********************

The list is from another poster on another website. It is some of the final reports/results we are not privy to YET, and the list grows! the JoseBFishin’ isn’t going to acknowlege ANYTHING that points at caseys guilt. like true scamthony’s they see what they want to see, hear what they want to hear and IMO wouldn’t consider casey guilty unless they saw her doing the evil deed, (and even then they may claim it was a stand in)
nothing i post over there even goes into moderation so i don’t even attempt anymore,,,, so much for everyone being entitled to their opinion. if you suspect Casey is guilty our voices and opinions are not allowed there.

  24. cecelia February 7, 2011 at 9:38 am #

The eyelash in the napkin is part of the discovery,,, the results of the eyelash are not released. like much of the inculpatory evidence against casey.

  25. Anonymous February 7, 2011 at 10:55 am #

There isn’t much evidence indicating the defendant did not commit the crime.

  26. damagdpets February 7, 2011 at 5:37 pm #

Cecelia, Thanks again for bringing the info. With only 2 months to go I don’t know why we have not seen the rest of the discovery, mostly the depositions of Mallory and the like. I don’t know how many were done by the defense, the prosecution or both. The discovery so far by the defense has been pitiful. The majority consists of news articles or interviews by news agencies. This points out that a “woe as me defense” is in play because I have not seen anything with substance. Their star witnesses Laura B, Joe J, Brandon Sparks all have disappointed the defense with no reasonable doubt. They can’t even communicate with their experts. Quote Baez, ” It will all be explained when it come out at trial.”
    Ya sure…..

    • Annegirl February 7, 2011 at 7:30 pm #

Haha…yes it will be explained when it all comes out at trial. The prosecutors will splain it all and the defense will hafta listen. Cause they got nothing. That is a quote I can agree with Baez about.

So I have a question or two or three…Do you think K. Belich will bring charges against C Mason, if in fact he did touch her person somehow after the hearing Friday, when they had some sort of commotion outside the courtroom? I hope that is the case, since we haven’t seen any footage. Would they being holding the footage as proof? We haven’t seen any that I know of. Has anyone seen footage of that?

  27. kathlb February 7, 2011 at 7:49 pm #

If I were Mason’s wife, sister, brother or even cousin, I would be down on bended knee pleading with him to get out while the gettin’s good! Couple his convenient hearing loss, his mush mouth questions that sound more like Prof. Irwin Corey, the doubletalking comedian of years gone by, and his connection with the lying Baez in what will be a huge resounding flop as the jury slaps their notebooks down after finding her guilty and that she should face the same fate as little Caylee, he will have ruined a somewhat illustrious career by going out in a fizzle.

I also watched part 2 of the hearing today and saw Mason constantly checking his watch while JB argued with the judge. Then Mason would look at Judge Perry and roll his eyes and wipe his face and hang his head. He and the Judge were both about ready to yawn and then watch JB go up or more importantly down in smoke with his client.

  28. Anonymous February 7, 2011 at 8:54 pm #

The defense has already seen Mr Ashton give a preview of what is to come May 16, 2011 during his opening statement: http://www.youtube.com/watch?v=1rAV535Cgi8

Why would any self respecting lawyer allow his client to face the death penalty when he has no clear and definitive evidence pointing to his client’s innocence?
To me LWPOP is a gift.

  29. Anonymous February 7, 2011 at 11:09 pm #

Damagpets-In Supplemental Reports (S.R.) published we can read about the warrants and affidavits which are sealed.(see Supplemental Reports relative to Mr Kronk’s interviews and the return to the Anthony home after the remains were found in Dec 2008). I will double check other S.Rs. to refresh my memory.
