Does Jose Baez Think Before He Speaks?

During a hearing on March 3, 2011, defense attorney Jose Baez called to the stand an attorney who had worked at his firm and had interaction with Casey Anthony which is protected by the attorney-client privilege.  The questions of Mr. Baez for his employee can be heard at the following link.

Jose Baez: “Do you know if it revolved around a meeting with George Anthony and Casey Anthony?”

Gabriel Adam: “That sounds familiar.”

This is not an affirmative answer.  “That” distances Mr. Adam from his statement.  The word “familiar” is not an affirmation Mr. Baez’s question reflects reality.  Mr. Adam did not answer the question.

Jose Baez: “OK.  And on August 14, 2008, did Casey Anthony have a visit with George and Cindy Anthony?”

Gabriel Adam: “I believe there was one scheduled.  I… I cannot remember if it actually happened.”

Another song and dance resulting in a non-answer.  The word “believe” indicates this may or may not be true and is still open to question.  The word “actually” demonstrates a sensitivity to “happened”.  Mr. Adam does not want to state if the “visit” occured or not.

Jose Baez: “Do you recall if prior to that date that… we… that uhhh… that we had instructed Ms. Anthony to stop recieving visits from her family?”

Mr. Baez asks a question violating the attorney-client privilege of both his employee and Casey Anthony.  Mr. Baez is almost unable to verbalize this question.  The excessive use of the word “that” indicates a distancing from the instruction to Ms. Anthony to “stop receiving visits”.  A careful listener must ask if such an instruction had been given “prior to that date”, a “date” which is Mr. Baez again distances himself from with “that”, a sensitive “date”.

We have often seen Mr. Baez stutter and stammer on national television and in local news interviews.  It is understandable in a setting in which Mr. Baez is being asked questions for which he may not have been prepared for him to stumble and rephrase answers on the fly.  However, this is a court hearing.  Mr. Baez called this witness.  Mr. Baez had opportunity to plan his line of questioning in advance.  Mr. Baez could have written his question in the best possible format prior to entering the courtroom.  In other words, Mr. Baez could have adequately prepared for this hearing, but from the verbalization of this question, it is clear he did not.  Mr. Baez’s client and all defendants in the United States deserve an attorney who prepares their cases, strategies, and questioning in advance of the moment of truth.  Mr. Baez’s client does not have such an attorney.

Gabriel Adam: “I’m not really…”

Jose Baez: “If you recall.”

Gabriel Adam: “This is a tricky situation because I’m not really comfortable with answering questions that I… of things that I said to my client at the time.”

Mr. Adam demonstrates through his answer he is a superior attorney to Mr. Baez as Mr. Adam immediately recognizes the danger inherent for the client in this line of questioning.

Judge Perry: “Mr. Baez.”

Jose Baez: “We’re talking specifically about that.”

Mr. Baez verifies he also recognizes the danger to his client from his question and attempts to assure the court he knows what he is doing, even though he planned poorly for this moment.

Judge Perry: “You represented to the court that you were talking about a visit him being there with law enforcement and that’s where you were going.”

Jose Baez: “I am going there.”

Judge Perry: “Now what you are about to do and you need to think about it is you are asking questions about conversation between attorney client.  Remember the following.  You cannot use the attorney client privilege as a shield then turn around and open it up and use it as a sword.  Once you open it, it’s open.  So, you need to think long and hard about the questions you’re asking.”

Judge Perry is also concerned for the best interest of the defendant, going so far as to offer advice to Mr. Baez.

We have learned not only does Mr. Baez not think before he speaks, he does not prepare for court even when his desired line of questioning will open his client’s attorneys to questioning by the state about confidential defense matters.

We have learned Mr. Baez is not qualified to handle a defense of this magnitude, especially with the life of his client hanging in the balance.

      Thank you for posting this! I’d missed the exchange between Attorney Adam and Baez, though I’d heard and read about it. I am flabbergasted anew having seen and heard the questions that Baez posed. He is very fortunate that Judge Perry was on his toes and stopped the line of questioning for the sake of the defendant. Unbelievable! We see time and time again how Mr. Baez does not even come close to providing an adequate defense, and that is what infuriates me! If the situation regarding the representation by this defense team were fiction, no one would believe it. But, this is our system, like it or not, it’s being played, and the song sure ain’t music to my ears!

    Bull — I’m not convinced Baez could prepare for court, even if he possessed the work ethic required to do actual WORK. It’s turning out he’s every inch the dim bulb so many of us suspected he was. His questioning of every witness, not just Gabriel Adam, has been just ungodly tedious and pointless. There’s no way to tell where he’s going with his line of questioning, and wherever it is, he never gets there. Mason makes marginally more sense once you pick through all the mumbled good-ole-boy crap he wraps each point in, but he is neither well-read on this case, nor in tune with how his client is/will be perceived. To try to frame up the lying, smut-mouthed, narcissistic felon as a little slip of a baby girl all skeered and clammy in the presence of the big bad detectives shows just how tone deaf he is (in addition to being hard of hearing).

      I think Mason may be very persuasive to the jury during the trial. It is easy for us to see behind the facade, but we have to remember the jury will be coming with virtually no prior knowledge of this case. They will see a slip of a girl being harassed by the state until they begin to see the evidence presented by the prosecution.

      But Baez will look like the idiot he is no matter how little knowledge they have about the case.

        The jury will also have a bird’s eye of her for 2+ months. All the preening, the come hither looks to Baez, the stifled giggles, the inability to keep her hands off herself, the maniacal behavior with the pen and legal pad, the haughtiness, the defiance, the cold stare and the shark eyes. I say LOL to Mason (that’s Lots of Luck, of course) trying to convince a jury the female sitting before them — the one with the dead toddler — was a defenseless lil girl targeted by LE and the state. I predict Casey just being Casey in that courtroom will do enormous damage to her case. (Which, imo, is the way it should be.)

        That was very nice of you conserning mason but as sombody who never heard of him and than watching his demenor as he speaks to the court I find my self becomming adgatated over his mumbling and “good ole boy” speech. He is hard to follow and speaks way to fast I hope the jury find this about him also! Great Artical!

    “The documents also show when he asked Casey what she couldn’t tell him over the phone, she said her brother Lee knew most of the story about what had happened to Caylee and she would tell him all about it “some day.””

    We know Cindy Anthony was actively trying to frame multiple people outside the family for Caylee’s murder.

    But when you take KC’s statement to her friend, add it to a Lee asking questions on jail video demonstrating he had some knowledge nobody else did, take into account his personal investigation based on information KC was giving him, then add in Dominic Casey attempting to plant evidence on a body someone told him was in the woods, then think about the nasty reaction KC had in court recently to Lee saying he would have lied to her to find Caylee and her refusal to look at him as he left the courtroom even as he tried to say goodbye to her, it makes me wonder if KC was trying to frame Lee?

    Why tell a man involved in the NCIS your brother knows all about the disappearance of your child?

    FYI—Someone in LE who I completely trust has told me that without a doubt JoseBgood is actively behind the mission site. I am NOT surprised at all. The man has to vent his ego somewhere and after all…he does had four loyal devotees! Isn’t one of them Wanda Wery from the fake OIA sighting? I think some of Andrea Lyon’s lackies might be involved as well. The verbage just sounds very “Lyon-like”.
    Just some ponderings.
    Shall we post guesses on what month/year Baez gets eventually disbarred? Word has it there is A LOT more we (the public) don’t know about yet!

        I am always ready to listen with an open mind to anyone’s views and reactions to this case. But I am going to bring it all back to the evidence.

      Bozo got one thing right: “I’m trying to get this picture out of my head,” he said.” That’s what I go through every time she attends a hearing…double that for seeing Cindy at the hearings, & quadruple that for having to listen to Cindy’s voice whether on the stand or in the media. ((blech))
