Does Jose Baez Ever Prepare for Court Proceedings?

Defense attorney Dorothy Sims found herself unprepared for the deposition of a defense expert witness on December 21, 2010.  An exchange between herself and prosecutor Jeff Ashton which revealed Ms. Sims had not been supplied with photographs taken by the expert and critical to the expert’s deposition testimony may be found at the following link.

Jeff Ashton: “It’s a huge file.  I’m surprised Jose didn’t give them to you for this.  But no, it’s too big a file.”

We have learned lead defense counsel Jose Baez did not send his co-counsel the defense photographs which had been entered as evidence and around which the testimony of the deposition revolved.

We have learned even though Mr. Baez feels Ms. Sims’ participation is critical to a victory for the defense, he did not supply her with the bare minimum of material needed for her to succeed in her efforts.

We have learned Mr. Baez, the only defense attorney who made money from this case, left his pro-bono co-counsel out to dry.  Will he do the same for his client?

    Jose reminds me of a spoiled, insecure little brat of a boy. Playing by himself is no fun, so he invites a few kids over. But he won’t share his toys, so they don’t hang around. Soon, he’s all alone again, trying to look like he’s having a good time.

    Just when I think I have seen it all, Bullstopper reports on another folly that Baez seems to have engineered. If I were Dorothy Sims, I would be
    “Gone like a freight train
    Gone like yesterday
    Gone like a soldier in the Civil War
    Bang bang!”

    Forgive my lapse over into singing but this “lawyer” seems to bring out the worst in me. Could he really be that ignorant, mean and lacking in even the basic caring of his client? Or is this a setup to pave the way for an ineffective counsel filing by Casey which would delay the trial indefinitely or get her a re-trial and give Baez the time he needs to pen his “blockbuster book”? I just can’t wrap my head around his ineptitude otherwise. He can’t be that mean and vile and even stupid that he would do that to a co-counsel. Would he? If so, she really does have a case for ineffective counsel and that will be his final gift to her since he took all of the money and has no desire to “lawyer” once this is over. He will become an “author” and make a fortune in his mind. I just can’t understand this basic lack of following basic rules in representing a client.

    Oh, and I can understand the wish of many to see him fired and left with no publishing house that would touch any book by he or the Anthonys and be back to ambulance chasing. Well, Bullstopper, you got my blood pumping quickly this morning. 🙂

    And another thought, if this isn’t a plan for a plea of ineffective counsel, what is Cheney Mason doing that he is letting this happen to their client? Both of them are this stupid? Hard to believe in this camp.

    Well we will find out how prepared he is for todays hearing in a few hours. I see the Defense team (loosely applied term) has filed for a re-hearing of motions that Judge Perry ruled on last week. Anyone have a take on what this means beyond it being a stall tactic? does Judge Perry even have to rule on this or can he just summarily deny all motions as already being ruled upon?

    LDB’s questioning of the defense expert is a little comical. The poor guy is being taken apart systematically buy LDB because it seems he read a few articles and watched a few dogs in a search so know he and the defense claims he is an expert. I have flown a plane several times….does that make me a fighter pilot?

    All of Baez’s deceitful actions have just brought all the forensics in (IMO). Casey is still sitting there like she is at a board meeting. Unreal! Ann Finnel is an excellent lawyer, and she knows it’s time for her to step in.

The entire team is a cluster of malfunctioning robots stuck in IDIOT mode. I’m just waitin for the day they all short circuit at the same time…

    Every session that goes by like today makes me realize that it was Karma that HHJP ended up on this case.
    A judge with less knowledge and stamina or maybe even someone who wasn’t too concerned with appeals, might have just blown their cool with Baez and co. Might have just told he was the most stupid man ever in a courtroom, hit the road….
    HHJP is going to see this fiasco through to the end no matter what bullchit comes from the defense. I can’t stand that he doesn’t just open up on them but it’s a good thing or Baez would be making the tv circuit sniveling about bias.

    If it weren’t so sad concerning a beautiful baby’s murder, it would be laughable. Baez trying to spin it and smirk like something was happening the way he planned it was hilarious though. LDB took the Canadian apart at the seams and he will never be able to sew himself back together again. Tomorrow should be another fun day in defense self-destruct land.

      Venice, I thought the hearings went well. I saw that Baez took over after yesterdays bad show by Sims. I thought Baez did a decent job although Dr. Vas schooled him up and down the court room. I was so blown away By Dr. Vas’s credentials and time in studies at UT. I wished Ashton would have asked him how much money he made. Research scientists are not the best paid. If in fact this guy gets a piece of a new patent, GOOD for him! It’s called the American way. He didn’t work for 22 years waiting on the Anthony case to come a long. I thought that line of questioning by Baez was truly a low blow to the man’s education and hard work.

      The bias and conspiracy theory have been there long before Mason filed his motion. When you come up with one bad case out of 2.2 million incarcerated, you have to try harder to be heard. The innocence project does not even take a case to review without DNA evidence. Accordingly if there was one bad cop, prosecutor, etc., then all must be bad and cases not right.

    OMG……Mason accuses Perry of being biased. BAD MOVE. It’s on the cover of the OS. Mason does not want his legal reputation soiled, so he’s hoping for a mistrial. Who on earth would buddy up with Baez?

      This is a very bad case of “Careful what you wish for.” They got Judge Strickland removed and gloated over it. I don’t think the new judge is cutting them slack only because he quotes case law standing on his head. Look at Perry’s record to see how many of his cases came back on appeal. Judge Perry took over, set guidelines, deadlines and is kicking ass and taking names regardless of what side you are on. He has set the date of trial and no matter how much screwing around the defense does…you can’t put off the inevitable.

        I totally agree! They thought they were so sly getting Strickland removed. Well, this Judge is FAIR and BY THE BOOK and he’s going nowhere. They can appeal until they are blue in the face, and you would think Mason knows he is in a losing battle. Noone twisted his arm to climb aboard this trainwreck.

    Mason is old enough to know that if you lie down with dogs, you wake up with fleas. If he is so worried about a sullied reputation, why did he hitch himself to this runaway wagon by announcing that he was taking on the case for “fun” after previously announcing Casey would be found guilty.

    The problem the defense is having is that they have nothing but an entire family of liars, thieves, and one accused murderer. And juries convict liars.

    All they have left is to continually reject all manner of premise in this case. Like the 911 call, the smell in the trunk, her mother’s own admision that Casey is a liar, that LE tried many avenues to find Caylee, etc. And now they claim that HHJP is biased.

    I think he is only bised on the letter of the law and nothing more. But, it worked before with Strickland, so what the hell, try it again.

    But it is an actual smart move by the defense to claim bais, now when anything goes against them (after the re-filing) they will again claim it is because of bias. And may get an audience with an appeal court.

    There will not be another judge appointed in this case. HHJP was hand picked to get this dirty job done and he will! Perry is very awear of what this defense is trying to do and you can bet your bottom dollar he did a lot of “homework” before he rendered his rullings. My money is on Perry. Mason is splitting hairs. Wait untill Perry allows Dr Vass’s tesimoney, the K9’s the plant root growths, the stain..maybe not the heart sticker..but who cares..outt send defense into the outter limits..good lets hope they can’t find their way back!

    Yep, the Judge has known from day one what this group is capable of and he knows the law inside and out and will not do or rule on anything that would take even the remotest chance of being overturned. He has bent over backwards to be lenient with them and this is the thanks he gets. There will be no more big favors, it’s strictly rules and law from here on out. And about time too.

    Truthfully, I could care less what someone looks like or whether or not they have the right makeup on. 😉 If they would just stop telling falsehoods and act professional once in awhile. Defense lawyers are usually disliked because they represent the “bad guys”. But not all defense lawyers do what this group has and is doing now. Not all take hundreds of thousands of dollars and do no work for two years.

    Not all defense lawyers actively tell their investigators that if they find “something” not to call 911 but keep it a secret. And I could go on and on. The Judge needs to put a halt to all of that and I believe he is now. He gave them chance after chance and now he’s not giving them any more special favors. They had better perform correctly from now on or suffer the consequences.

      Defense attorneys are not only an integral and necessary part of our legal system, there is a possibility each and every one of us may at some point in our lives need their services for either ourselves or our loved ones. Defense attorneys defend the freedoms of the American people. Their role is as important as law enforcement, representative government, and national defense. Our country is the greatest in the world because we are a society based on personal freedoms which allow every person to seek their greatest potential and through that process many good people voluntarily choose to join the armed forces to defend our freedoms from external threats, join law enforcement to defend our citizens from internal threats, become a prosecutor to seek justice for victims of crime, become defense attorneys to protect our rights as individuals, to serve in governments local, state, and national to better our communities and country, or to be part of the economy which drives the global markets and maintains our position as a superpower in a world where we are now the only one.

      But there are individuals who place their own self-gain above all other concerns. Because we enjoy such great personal freedoms, these individuals are able to hi-jack portions of our systems for their own self-interest, such as those who steal money from others in pyramid schemes or by utilizing the retirement funds of employees for illegal, but unmonitored, purposes. In this case, not only is a particular buffoon hi-jacking the legal system for fame and fortune, he is incompetent at his job as well and has enlisted the help of like-minded individuals to all but ensure a woman who probably deserves it is sentenced to death.

      But the ends do not justify the means. The ends never justify the means. Although I believe KC is guilty, I have no opinion about the imposition of the death penalty. That is for a jury to decide and I am grateful our system does not place the burden upon my shoulders as the decision to take the life of another is one which will be with the 12 for their entire lives. They are taking on a responsibility which is rarely appreciated by the general public. The judge also must live every day of his life with the death of others upon his conscience and for a man of great conscience like the Honorable Judge Perry, it doesn’t matter if the defendant is guilty and deserves it and the sentence it justified, it is still a responsibility which can never be escaped even after the sentence is carried out. As news articles are pointing out, Judge Perry has sentenced 8 murderers to death and I guarantee you those decisions continue to weigh heavily upon his mind as he presides over this trial, especially as he observes the buffoonery of the defense as none of them, with the exception of Mason who appears to be unconcerned with the possibility of a death penalty, have every borne the burden carried by the judge.

      The judge and the prosecutors in this case understand the severity of the possible outcome of this case and do not take it lightly. Mr. Ashton and Ms. Burdick are as concerned for the rights of the defendant as the judge and it is clear from their professional suggestions to the defense they do not want Ms. Anthony sentenced to death because her attorney is an idiot.

      Should the prosecution be successful and the greatest penalty imposed by the jury, I believe the prosecutors and the judge will always carry some doubt in their mind as to the outcome being due to the ineffectiveness of counsel.

      Thank goodness our judicial system allows for automatic appeals of death penalty cases and let us all hope a defense attorney with a moral imperative defends Ms. Anthony in the future, if not to protect her as she may deserve what she gets, but to protect us all.

      And may those who have profited from this case and used the death of a child for their own purposes such as fame and fortune suffer their own personal hells by realizing their actions have been at the expense of two lives.
