Is Jose Baez Guilty of Ethical Violations?

In January 2011, when asked to speak about a bar complaint filed against him by a judge in Orange County, Florida, which concluded with a ruling of no probable cause, Mr. Baez made a single comment which can be found at the following link.

Jose Baez: “I have been cleared of all Bar complaints filed against me.”

“I have been cleared” – This is a truthful statement.  Mr. Baez has “been cleared”.  However, it should be noted this is not a declaration of innocence and this is not a statement Mr. Baez did not violate his ethical responsibilities.  In fact, the structure of this sentence attempts to pull responsibility away from Mr. Baez for possible ethical violations by putting the action in the hands of someone other than Mr. Baez, who did not clear himself.  He has “been cleared” by someone else.  In this case, we assume the someone else is the Florida Bar.

“of all Bar complaints” – The word “all” indicates the existence of more than one Bar complaint.  There are multiple Bar complaints.

“filed against me” – This phrase limits “all Bar complaints” to only those “filed”.  Mr. Baez is acknowledging there are other Bar complaints, but they have not been filed.  This distinction is important as the phrase “Bar complaints” would have indicated only filed complaints as any not filed would not yet be “Bar complaints” as they were not yet in front of the Bar.  By adding the phrase “filed against me”, Mr. Baez is highlighting his sensitivity to “Bar complaints” and limiting his response to only those filed thus far.  As seen in the linked news article, an additional Bar complaint was filed within a month of this comment being uttered.

We have learned Mr. Baez avoids speaking about his guilt or innocence of ethical violations.

We have learned Mr. Baez feels a need to distinguish between filed Bar complaints and those not yet filed.

We have learned Mr. Baez was most likely aware of a soon-to-be filed Bar complaint when he made this statement to the press.

    Here is the guy’s story which he told to police after waiving his right to silence:

    “He said that he handcuffed her when he thought she was going to use a knife. When he tried to take the handcuffs off, she struggled and he shot her in the abdomen, according to the report.”

    So, his defense attorney is backing “his position” of self-defense, even though his story is she was handcuffed at the time… illegally handcuffed… and, therefore, helpless…

    “He said he pulled out his .38-caliber handgun, took her from the kitchen to the bedroom and handcuffed her there. He said as he tried to unhandcuff her later, she struggled and he shot her in the abdomen. He told police he remembered a second shot to her neck, after which he fled the scene.

    Ho told police he tossed the handgun in a canal. Hospital staff said the shot to Carter’s abdomen was at close range, showing gunpowder residue.”

    We were discussing this in Bull’s previous article. I would think it is fairly serious. There is a boatload of information out there relative to how Mr Baez conducts himself and who he has the misfortune to befriend and manipulate. He has no regard for the law. What a mess.

    Bill Schafer (WFTV legal analyst)did a scathing analysis today of these latest allegations w/Kathy Belich. On a scale of 1-10, if the allegations are true, the seriousness is a 10. Looks like Mr. Baez is indeed in hot water.

    as all can see that thats the reason why lyons and baden left the team.they saw just what was going to go down and so they decided to leave the defense team which was good for them.as l said long time now that bozo will soon be disbarred and just look at whats happening to him now?everything is going as planned.they should take that money that the court allowed him to have for more investigation because he aint doing none of that.he is keeping the money for himself.time to get him off and l am glad bozo is in trouble its about time.

        Maybe Mason was told by the head conman,Hose’ Baez that there was a witness that would testify to the water level and the gazillions of volunteers that would back it up and that he had some real fine info that Kronk was a duct taping sadist and that the Grunds were into human sacrifice and blah, lie, blah, lie and because Mason is a lazy old fart he didn’t bother to check any of it??

    For the sake of argument….do you really think Baez or any other attorney would incriminate themselves? Baez may be sly at avoiding his own demise but the motions he has filed from day one tell a different story. He has had the distinction of the judge, prosecutor and even the public note how bad his motions are. So I want to ask the big question…Will this come to appeal because of ineffective counsel or will it be a mistrial before it even gets started? It’s quite obvious that Cheney Mason and no one else is looking over Baez’s shoulder. He is making mistakes all by himself. I’m getting a bad feeling of his short comings and no oversight. Caylee and the Tax Payers of Florida deserve better than 2 1/2 years of BullShit!

      There will be no mistrial – if you bother to read a bit beyond what you chose to see you will have seen Mr. Schaefer’s comment regarding this. Nothing regarding Baez will be attended to until after the Anthony trial

        I don’t think it can be a mistrial unless there’s a trial and I think he has made it clear, he doesn’t feel he needs oversight, he certainly appears to reject sound legal advice and direction so whatever happens is all on him. Hope Mason can step over Baez’ fat ass and take up the fight for princess while Bozo fiddles in the side chair.

      This has been my gripe. With all the “so called experts” on this team why oh why aren’t they assisting Baez with the motions? Or if they are, is he not listening to them? Baez’s ego may be what is driving him. And if it is. He is probably putting the needle in Casey himself. Not to forget to mention her own family.

    Baez has the option of behaving in a professional manner like most other attorneys concerning their pending cases, saying “NO COMMENT” or some speaking-without-saying-anything equivalent like “I don’t feel comfortable commenting on my pending cases” or “Our office has a strict policy of not commenting on pending cases.” Or he could just be silent as he walks past reporters.

    I think after Casey is convicted, Cindy will be screaming in front of any camera that will have her, that her lovely daughter/wonderful mother was convicted because of Baez and his “antics”.

    “Ineffective Council,Screams Cindy Anthony, Mother of convicted child murderer” the healines will read!!! LOL!

    Besides the automatic appeal if she is sentenced to death, she will go for an appeal based on ineffective council/the antics of her attorney(s). But since they have no money I highly doubt there will be any attorney willing to go pro-bono for an appeal. Not one attorney will touch that hot mess!

    Damagdpets-There is the Fifth Amendment. No one is compelled to be a witness against themselves. I don’t know how lawyers “incriminate themselves” but from my understanding of Mr Shaeffer’s article, it is alleged that Mr Baez lied in open Court in front of Judge Perry.

    Katprint-That is what Mr Baez never seemed to grasp-the concept of saying absolutely nothing. He had a client who was “sticking to her story” and it gave her the opportunity to be, for all intents and purposes, an “elective mute”. Your suggestions above would have provided him cover when the big guns came a callin’.

    Damagdpets-I think an appeal on ineffective counsel would depend on many things. We all know the funny stories and the appeals that site their attorney slept during opening statements, intoxicated during the closing etc. were not seen an reasons for ineffective counsel.

    see CA v Sommers. Ms Sommers lawyer allowed things in that should not have been allowed in. He did not cross witnesses well. He made mistakes and fell on the sword for his client. She was a bad girl and he was an honorable man, a not so fast on his feet lawyer but a good and decent human being.

    Yes, Baez is guilty of ethics violations. My question is can he be disbarred and how will that effect Cases case. I would rather see him disbarred now as opossed to after the trial. I don’t want her to have grounds for an appeal

    becca-According to Mr Shaeffer this matter will be resolved after the trial. No one knows yet if it is a professional or ethical violation (OS) but it is serious enough to get him disbarred but not before the trial.

    I dont know where else you may have written about this but because you are very analytical of people’s writings i thought “who better to ask”. As you have probaly read or seen across the news is the report concerning the diary found in KC bedroom and the notation of ” ’03” in the corner. It was reported that the diary was sold in 2004-2005?

    It is of my opinion, and many others, that the 03 came around the time of Caylee’s dissapearance and 03 was put there to throw LE off. (i recall her spending an enormous time in her room when she was released from prison)

    What’s concerning, in my opinion, is her “bullet point” statements trying to convince herself?
    -I have no regrets
    -I did the right thing
    -I’m finally happy
    -I have made new friends

    If she is trying to convice herself, in my opinion, she is alluding too a guilty conscience what do you think?

      I think this piece of evidence suffers from the Rorschach ink blot effect, just like her reaction to the news Caylee’s remains had been discovered.

      In other words, everyone will see what they want to see.

      Since we don’t know the event to which she refers in her writing, we are forced to choose an event, an action which destroys any chance of understanding her intent because choosing the wrong event changes our reading of her words.

      No one knows what the ’03 references. It could be a year. It could be a month. It could be a doodle. It could be anything. It is not necessarily tied to the rest of the entry. Or it is intricately tied. Maybe she was writing in code and the ’03 tells her the correct cypher to use.

      I have even heard a theory she was re-copying an old diary into a newer book because sometimes girls do stuff like this. Doesn’t make much sense to me, but I have never been able to keep up on a journal, so I can see where you might end up with several partials.

      I do not believe this diary entry will have much, if any, bearing on the case.

      However, I do believe the research into the manufacture of the diary proves beyond doubt Jose lied to the public about the diary being written in 2003. Although it won’t do much to buttress the case against Casey, it is another huge blow against Jose’s credibility and illustrates he is willing to lie about anything and everything. Or he is stupid enough to believe the lies of his client and repeat them in front of a camera without a single thought as to possible proof surfacing to make him look like an idiot.
